Article Description
This article deals with the French approach to the public policy exception as an institute of private international law. The main aim of the article is to answer the question whether the approach of French doctrine and practice, which deal with this institute in detail, is relevant for Czech legal science and practice. After an introduction of the public policy exception, the article focuses on at one of the conditions of its application, namely the intensity, which affects the application of the various forms of the public policy exception - attenuated public policy, public policy of proximity and consideration of foreign public policy. Their nature, function, and the way of application are analysed and it is also stated whether and how these forms emerge in Czech practice and doctrine. Lastly, the position of the Czech and French approaches to the public policy exception is evaluated and is discussed possible inspiration for Czech legal science and practice.
