The Supreme Court of the United States affirmed that a petitioner alleging racial discrimination in the jury selection process in violation of the Fourteenth Amendment has to meet the prima facie requirements under the Batson standard. Miller-El v. Dretke, 125 S. Ct. 2317 (2005).
