Deutsche Zusammenfassung: Das Europäische Konzernrecht steht unverhofft wieder auf der rechtspolitischen Agenda. Wer Reformpläne schmiedet, sollte sich zunächst der Wege und Irrwege vergewissern, die man in mehr als fünf Jahrzehnten intensiver Diskussion beschritten hat. Der vorliegende Beitrag würdigt in einer akteurzentrierten Annäherung die konzernbezogenen Regelungs- und Denkimpulse von Kommission, Mitgliedstaaten, Europäischem Gerichtshof, Wissenschaft und Kautelarpraxis. Anschließend mustert er die zahlreichen unionsrechtlichen Vorschriften zu Unternehmensgruppen, die sich teils im Konzernrechtszentrum, teils in peripherer Streulage finden. Schließlich erörtert er, wie man die vielen verschiedenen Gesichter des Konzerns im Europäischen Wirtschaftsrecht zueinander in Beziehung setzen und wissenschaftlich verarbeiten kann. English Abstract: Unexpectedly, the law of corporate groups is back on the European political agenda. In order to move ahead, it may first be helpful to review the wrong turns and ways forward of past discussions. This paper does so by adopting an actor-centred approach, analysing the proposals and achievements of the European Commission, the Member States, the European Court of Justice, legal scholarship and corporate practice in this area. It continues by taking stock of the provisions related to groups of companies in European Union law whether at the centre of group law or scattered around its legal periphery. In conclusion, the paper points to the many facets of groups of companies from the different areas of European economic law and asks how they can best be correlated in order to develop a coherent overall framework.
